How this works

Where cash bail is deposited with the court, the money is held and generally returned once the case ends and every required appearance has been made. Administrative fees, and any outstanding fines, may be deducted first.

Where a bondsman posts a bond, the premium is the fee for that service and is earned when the bond is written. It is not returned. Collateral is a separate matter and is returned only if the bond is exonerated.

What happens to the money if a hearing is missed?

The bond can be forfeited. With a court deposit the full amount may be kept. With a bondsman, the bondsman may pursue the defendant or seize the collateral.

How long does a refund take?

It varies widely, from a few weeks to several months, because the court has to confirm the case is fully concluded before releasing the funds. The clerk can tell you the local process.
